The Texas Racing Commission has issued a memo outlining a revised penalty guideline for clenbuterol overages and the new policy goes into effect immediately. (The maximum allowable level for clenbuterol is 140 pg/mg urine, according to the commission.) The revised policy drops the horse ineligibility provisions, according to a commission attorney.
The penalties operate under a lifetime count, instead of a 365-day count, as far as how violations are determined to be second, or subsequent offenses, according to the commission.
On first offense, there is a $1,000 fine, a 30-day suspension and loss of purse. .
On second offense, there is a $2,500 fine, a 60-day suspension and loss of purse.
On subsequent offenses, the fine is $5,000, the suspension is 120 days and there is loss of purse.
